Terms And Conditions

Important
This page is a practical starter template, not legal advice. Dutch and EU consumer rules can override your own terms, especially around online purchases, subscriptions, withdrawal rights, and unfair terms.
Service
Stay Fit provides an online fitness accountability membership with meal plans, gym schedules, member check-ins, meal photo uploads, community support, and admin review. Stay Fit is not emergency, medical, physiotherapy, or dietician care.
Membership Payment
Membership is paid in advance through Stripe. The price, billing interval, and payment method are shown before checkout. Access may start after payment confirmation and account creation.
Refunds Under Dutch Law
Refunds and cancellations are handled according to applicable Dutch and EU consumer law. Stay Fit does not provide refunds for used membership time or for removal due to rule violations, including missing gym without a valid reason, abusive behavior, false uploads, or repeated non-compliance, unless mandatory law gives the member a right to a refund.
Cancellation
Members may cancel future renewal according to the Stripe/customer account process provided by Stay Fit. Cancellation stops future billing but does not automatically refund the current paid period, unless Dutch/EU consumer law requires a refund.
Consumer Withdrawal Rights
For consumers in the Netherlands/EU, legal withdrawal rights may apply to online purchases. Where the law allows, access can begin immediately only after the member agrees that service delivery starts right away and acknowledges that the withdrawal right may be limited once the service is fully delivered.
Program Rules
Members must follow the food plan, follow the gym schedule, upload meal photos, check in after every gym session, and submit a valid reason if absent. Admin decides whether a missed-gym reason is approved or rejected.
Community Conduct
Comments must be supportive. Negative, insulting, discriminatory, harassing, or unsafe content can be removed and may lead to a warning or removal.
Health Responsibility
Stay Fit provides fitness guidance and accountability tools only. It is not a medical service and does not provide medical advice, diagnosis, treatment, physiotherapy, or dietician care. Users should consult a qualified healthcare professional before starting a new diet or exercise program, especially if they have underlying health conditions, injuries, pregnancy, eating disorders, medication use, or any other health concerns.
Data And Photos
Members may upload meal photos, proof photos, comments, and progress updates. Members see meal photos from the latest 7 days, admin review occurs weekly, and meal photos plus connected records and comments are deleted automatically after 30 days. The separate privacy notice explains the wider data flow and GDPR rights.
Dutch Law
These terms are intended for a Netherlands-based business and are governed by Dutch law, subject to mandatory consumer protection rules that cannot be excluded.
Before Taking Payments
Add your business name, KVK number if registered, VAT number if applicable, address/contact email, privacy policy, and refund procedure.
Recommended Wording
Refunds and cancellations follow Dutch/EU law. No refund applies for used membership time or rule-violation removal unless mandatory law gives the member that right.
